Your purchases from 459 Government Solutions LLC d/b/a 459 Solutions are made subject to these Terms and Condition.  Please review them carefully before placing your order.

1. OUR PROMISE TO YOU. We will deliver to you the product(s) that you order at the location and date you specify subject to the terms and restrictions of our shipping partners.  There may be instances when we do not have an item in stock.  In that case, we will inform you via email of the problem and the status of any backorder. 

2. 21-Day 100% Money-Back Guarantee.  Please inspect the product(s) immediately upon receipt and notify 459 Solutions of any damage or shortage on the same day as delivery.  If, for any reason, you are not satisfied with your purchase, beyond damage or shortage,, you may return it for a full refund using the same method of payment within 21 days as follows:

  • You must notify 459 Solutions for authorization and any return paperwork must be completely filled out prior to refund.
  • Product must be in original condition.
  • Product must be in original packaging, uncut, unmodified and unused.
  • Product must be returned within 21 days through traceable means (e.g. certified mail, UPS or FEDEX) and tracking information must be provided to 459 Solutions promptly upon notification of intention to return item(s).
  • All original product documentation, licensing, and accessories must be included in returned package.
  • Refund will be immediately processed upon receipt of returned product by way of the original payment method.
  • Opened items with visible or mechanical wear and tear are subject to a 15% return policy.
  • Installed equipment and software are repaired or replaced under manufacturer’s warranty.
  • Special order items and custom configured items cannot be returned unless found to be defective; defective items are covered under the original manufacturers warranty.
  • Items not in compliance with this return policy will not be refunded.
  • We will make every reasonable effort to make sure you are satisfied with your product.

Please contact our return team at returns@459solutions.com and reference the original transaction confirmation number if you need assistance.  There may be instances when we have to ship your product from the vendor.  In order to properly address your return and refund, please contact us before you start the return process.  Beyond our 21-day guarantee, no returns or refunds will be accepted, even if the merchandise is defective.  However, we believe in customer service and will facilitate your request for warranty satisfaction from the manufacturer.

3. Prices. At the time of your order, you will receive the total cost which will include line items costs, shipping and handling, and any applicable sales tax. Where applicable, the buyer is responsible for the payment of all customs duties at the time of purchase. 

4. Delivery. We will delivery your item in accordance with the delivery method you choose at the time of purchase.  Delivery dates may be affected by incomplete customer information, billing verification or other causes beyond our reasonable control.  In such events, we are not liable to you for any loss of time, material or production or any other loss resulting from late delivery.  We will provide to you shipping information to include the shipping provider and order tracking number.  All orders received by 4:59pm EST will be processed that day.  You can log into your account and check the status of your order the same day the order is placed provided the order is received by 4:59 pm EST.

5. Payment Terms. 459 Solutions accepts the following payments: American Express, Visa, MasterCard, Electronic Funds Transfer, Certified Check and Personal Check.  In no instances will orders be processed until payment is processed.  There will be a return check fee of $35.  You agree to pay and/or reimburse 459 Solutions for any and all sales, use and excise taxes which may be imposed on you or 459 Solutions by any government entity as a result of sales to you, regardless of when such taxes may be assessed, imposed or levied.

6 .To obtain information about the manufacturer’s Return Merchandise Authorizations, simply email us at returns@459solutions.com for further assistance.  We make no implied warranties, including the implied warranties of merchantability or fitness for a particular purpose with respect to any goods or services sold to you.

7. Damages in shipping. Regardless of your shipping terms, we will assist you if the merchandise is verified as damaged in transit.  In the unlikely event this occurs, please take the following actions:

  • Do not accept a visibly damaged product until the person making the delivery has endorsed the air bill/bill of lading with a statement of the extent of the damage.
  • If damage is concealed and found after unpacking, retain all packing material and immediately call us.  Concealed damage must be reported within 24 hours from time of receipt of shipment.
  • Notify us immediately of damages so that we can provide you with assistance on the claim with the freight carrier.  When calling, please have the sales order number at hand.
  • Please send us copies of all air bills/bills of lading and inspection report.

8. Limitation of Liability. In no event shall 459 Solutions be liable to you under any cause of action or claim of any nature whatsoever, regardless of whether characterized as tort, negligence, contract, warranty, or otherwise, for any loss of profits or other economic loss, including, but not limited to, such losses as (i) wages paid to your employees, (ii) lost revenue, (iii) lost use of equipment, (iv) purchase, lease or other acquisition of replacement, substitute, or temporary equipment, facilities or services, (v) costs of capital, (vi) costs or losses related to downtime, (vii) manual labor costs, or (viii) any other indirect, incidental, special, consequential, or other similar damages arising out of any claim relating to your purchases of goods or services from 459 Solutions, including losses resulting from your general or particular requirements or needs, whether or not 459 Solutions, at time of contracting, had reason to know of such requirements or needs, and whether or not such losses could have been reasonably prevented by you by cover or otherwise.  459 Solutions liability to you shall in no event exceed the purchase price of the nonconforming goods or services giving rise to 459 Solutions’ liability to you. 

9. Choice of Law, Forum Selection. Finally, 459 Solutions controls and operates it business from its offices in Alexandria, Virginia, USA.  Consequently, any questions relating to these Terms and Conditions or their application in a particular situation shall be governed by the laws of the United States and the Commonwealth of Virginia.  Any legal or equitable action of whatever nature brought by you against 459 Solutions arising out of or related in any respect to these Terms and Conditions or your purchases or other dealings with 459 Solutions shall be brought solely in either the United States District Court in the jurisdiction of 459 Solutions principle place of business or the appropriate court of the Commonwealth of Virginia located in the jurisdiction where 459 Solutions has its principal place of business.    

10. Amendments. By purchasing from 459 Solutions, you agree to be bound by these Terms and Conditions in effect at the time of your purchase.  You agree that 459 Solutions may change any of these Terms and Conditions upon 15 days prior written notice to you and that such changed Terms and Condition will thereafter apply to any new transactions between you and 459 Solutions.  You agree that in the event that any portion of these Terms and Conditions is found to be unenforceable, the remainder of these Terms and Conditions will remain in full force and effect.
